
New legislation on 6th April 2024 - What you need to know

On 6th April 2024, Carer’s Leave will come into effect and the law on flexible working requests will be changing.
Here is what you need to know about this legislation.
Carer’s Leave
This is a new right that applies to all employees who have a dependant with a long-term care need. The right is for one week of unpaid carer’s leave per year. It will be a day one right and no evidence is needed to request the leave.
The leave may be taken as half days, whole days or as a block of one week.
The notice required to take the leave is as follows:
This new right will be applicable to two million UK employees who currently “provide” or “arrange care.”
The aim of the legislation is to make it easier for people who support dependants.
It is hoped that the right will help employers through a reduction in labour turnover and the associated costs.
Flexible working requests
The right to request flexible working will become a day one right with effect from 6th April 2024.
Employees will be able to make two requests per year. The employee will not be required to make suggestions to their employer on how their request might be accommodated.
The timescale for considering a request for flexible working (including holding all meetings and dealing with any appeal) will reduce from three to two months.
Employees must still put their requests in writing (i.e. by email, letter or on a request form) and clarify that they are making a “statutory request” for flexible working.
Employers still have the right to decline a request but they must have a statutory reason for doing so.

Employees can use the right to request flexible working to ask to work from home either permanently or on a hybrid basis.
